I understand and acknowledge that the are risks of personal injury, property damage, and death while participating in activities and events using the facilities, machines, tools, and equipment (collectively the “Facilities”) offered by STL Makers doing business as MADE (“MADE”). I understand that some risks are inherent in the use of equipment and hand tools or while making and fixing things generally, and that some other risks may arise from conditions, situations, or activities of which I am currently unaware. I understand that my use of the Facilities involves some risk of injury, particularly when used incorrectly or unsafely by myself or their members. With full understanding of the risks involved and despite this Release, I am willing to participate and use the Facilities.
I therefore agree to exercise extreme caution and care in my use of the Facilities. I will wear all personal protective equipment required by the demonstrations, and I will abide by all the rules in effect and follow any and all instruction and advice delivered from MADE staff, and from signs within the Facilities. I understand that certain safety procedures are required in order to avoid the dangers involved in making, fabricating, and running equipment. I will not use, touch, or tamper with equipment which I have not received training on within MADE’s facility, nor will I utilize equipment unless I have a current membership at MADE. I understand that use of equipment which I have not been trained on may result in injury to myself, and legal repercussion from MADE and its members. I understand that failure to follow these rules may result in permanent ejection from the Facilities. I agree to wear eye protection at all times when I am in the work areas and to take all precautionary measures as may be required.
I agree to assume all of the risks and responsibilities in any way associated with the Facilities and activities offered by MADE. In consideration of and in return for the services and Facilities which MADE is providing me, I hereby release MADE, its staff, its agents, its instructors, and its members from any and all liability, claims, and actions that may arise from injury or harm to me, from my death, or from damage to my property in connection with my use of the Facilities. I understand that this Release covers liability, claims, and actions caused entirely or in part by any acts or failures to act by MADE, its agents, its staff, its instructors, and its members, including (but not limited to) negligence, mistake, or failure to supervise.
I also agree to defend and indemnify MADE and hold it harmless from all third party claims for any personal injury, death, or property damage arising from my conduct. In the event of injury, accident, and/or illness that incapacitates me (and renders me unable to give verbal consent), I hereby consent to receive medical treatment, which may be deemed advisable. I understand that MADE, its agents, its staff, its instructors, and its members are not liable for any injury which I may incur due to administration of medical treatment. I understand and agree that should medical services become necessary if I should suffer an injury, I will be solely responsible for those medical costs and expenses (and not MADE).
I further agree to MADE’s use of my image, images of any children I am responsible for, and any images of class projects or work in progress for MADE’s marketing use. I understand that MADE will not compensate me for such use. I understand that this Release means that I am giving up, among other things, rights to sue MADE, its agents, its staff, and its other members for injuries, damages, or losses I may incur, or that any of my children may incur while using the Facilities. I also understand that this release binds my executors, administrators, and heirs, and assigns, as well as myself.
